§ 21-86. Street lighting.

  • (a)

    Street lighting in accordance with the engineering design standards, design specifications and details shall be required in all new residential subdivisions approved after March 21, 1981.

    (b)

    Residential street lighting systems located on city property shall be owned, installed, operated and maintained by the electric utility company. The city and the electric utility company shall enter into a contractual agreement on the rate and maintenance of the street lighting system under the group V lighting rate plan. It shall be the responsibility of the developer to:

    (1)

    Pay the electric utility company for the purchase of all components of the street lighting system.

    (2)

    Pay the electric utility company any cost incurred in the installation of the street lighting units not covered in the electric utility company rate for this service. This payment shall be required to be guaranteed as part of the plan A security as outlined in the developer agreement.

    (3)

    The style of lighting system, along with the purchase and installation costs, will be established by the city council. An alternate lighting system style will require city approval. The developer shall pay any additional costs.

    (4)

    All of the street lighting costs shall be guaranteed as part of the plan A security as outlined in the developer agreement.

    (c)

    As of March 12, 1981, street lighting operating expenses in all new residential subdivisions, except as stated in paragraph (b)(1) above shall be charged equally to the parcels of that subdivision based on the type of lighting system installed. The charge shall be uniform and imposed as a utility rate and be included as a street lighting charge on the quarterly utility bill. The street light utility rates are adopted annually as an amendment to section 2-3.

    (d)

    Billing payment and penalty provisions shall be enforced consistent with those in chapter 23, article II, division 3.
